Terms and Conditions

  1. Scope of Application

(1) These General Terms and Conditions (GTC) apply to all contracts between BlueHabits GmbH, Grünstraße 15 c/o Mindspace, 40212 Düsseldorf, Germany
(hereinafter “BlueHabits”) and the users of the BlueHabits app as well as other digital services offered by BlueHabits.

(2) These GTC apply both to consumers within the meaning of Section 13 of the German Civil Code (BGB) and to business customers within the meaning of Section 14 BGB, unless expressly differentiated.

(3) Any deviating or supplementary terms and conditions of the user shall not become part of the contract unless BlueHabits has expressly agreed to their validity in writing.

  1. Subject Matter of the Contract

(1) BlueHabits operates an AI-supported digital application that helps users develop, change, and establish personal habits. It is based on scientifically grounded behavioral and motivational models.

(2) In particular, the app provides analysis, coaching, reminder, and motivational features based on user input, usage behavior, and algorithmic evaluations.

(3) The specific scope of functions is determined by the current service description in the app, on the website, or in the respective app store.

  1. Conclusion of Contract

(1) The contract is concluded as soon as the user installs the app, creates a user account, and agrees to these GTC and the privacy policy.

(2) In the case of paid services, the contract is concluded upon completion of the relevant payment process via the app store or a payment service provided by BlueHabits.

(3) The user warrants that all information provided during registration is true, complete, and up to date.

  1. Requirements for Use and Age Limit

(1) Use of the app requires a compatible device and an internet connection.

(2) Use is permitted only for persons who are at least 16 years old.
Users under the age of 18 may use the app only with the consent of their legal representatives.

(3) BlueHabits is entitled to suspend or delete user accounts if there are justified doubts as to compliance with the age requirements.

  1. Use of the App and User Obligations

(1) The user undertakes to use the app exclusively for their own lawful purposes.

(2) In particular, the following are prohibited:

  • misuse,
  • manipulation of functions or data,
  • reverse engineering, decompilation, or automated access,
  • use of the app for medical, therapeutic, or diagnostic purposes.

(3) BlueHabits is entitled to further develop, adapt, or temporarily restrict functions, provided this is reasonable for the user.

  1. Prices and Payment Terms

(1) Use of the app may be free of charge or subject to a fee. The applicable prices are shown in the app or on the website.

(2) Billing takes place via the respective app store or payment service providers used.

(3) All prices include the applicable statutory value-added tax.

(4) For business customers (B2B), the individually agreed terms shall apply.

  1. Contract Term and Termination

(1) The contract is concluded for an indefinite period and may be terminated by the user at any time via the app or by email to info@bluehabits.ai.

(2) For paid subscriptions, the terms and notice periods specified in the app store shall apply.

(3) BlueHabits is entitled to suspend or terminate user accounts in the event of serious or repeated breaches of these GTC.

  1. AI-supported Functions

(1) BlueHabits uses artificial intelligence and machine learning to provide personalized content, recommendations, and evaluations.

(2) AI-based functions are based on probabilities and may be incorrect, incomplete, or inappropriate depending on the situation.

(3) Content generated by AI does not constitute binding instructions and does not replace professional or medical advice.

(4) The user remains solely responsible at all times for decisions made on the basis of the content provided.

  1. Personalization and Algorithmic Adaptation

(1) BlueHabits is entitled to personalize content, recommendations, reminders, and evaluations individually on the basis of user input, usage behavior, and algorithmic analyses.

(2) Personalization may change over time, in particular due to learning processes of the algorithms used, changes in usage behavior, or adjustments to the underlying models.

(3) There is no entitlement to any particular design, sequence, or intensity of personalized content.

(4) Personalization does not constitute any guarantee of a specific success, progress, or result.

(5) Further information on data processing in the context of personalization can be found in the privacy policy.

  1. Health and Medical Disclaimer

(1) The content provided by BlueHabits serves exclusively as general support in the development of personal habits.

(2) BlueHabits does not provide medical, therapeutic, or psychological services.
The app does not replace medical, therapeutic, or any other professional advice.

(3) Users with health complaints are advised to consult appropriate professionals before using the app.

  1. Geo-location Functions and Risks

(1) Certain functions may process location-based information, provided that the user has expressly consented to this.

(2) Use of location-based functions is at the user’s own responsibility. The user is solely responsible for ensuring that such use does not create risks to their safety, privacy, or the rights of third parties.

(3) BlueHabits assumes no responsibility for risks or damages arising from the use of location-based functions, in particular due to inaccurate location data, misinterpretations, or unforeseen situations.

(4) Details are set out in the privacy policy.

  1. Intellectual Property and Rights of Use

(1) All content, software components, algorithms, and data models of the app are protected by copyright.

(2) BlueHabits grants the user a non-exclusive, non-transferable, revocable right to use the app in accordance with the contract.

(3) Any use beyond this without prior consent is not permitted.

  1. Beta Features

(1) BlueHabits may provide individual functions as beta or test versions.

(2) Beta features may contain errors, may be changed or removed, and are provided without warranty.

(3) Use of beta features is at the user’s own risk.

  1. Feedback

(1) Users may voluntarily submit feedback or suggestions for improvement to BlueHabits.

(2) BlueHabits is entitled to use this feedback free of charge for the further development of the app, without giving rise to any claims on the part of the user.

  1. Liability

(1) BlueHabits shall have unlimited liability for damages arising from injury to life, body, or health, as well as in cases of intent and gross negligence.

(2) In the event of slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for this type of contract.

(3) Liability for indirect damages, consequential damages, or loss of profit is excluded.

(4) BlueHabits shall only be liable for data loss insofar as the user has carried out proper data backups.

  1. Data Protection

Personal data is processed in accordance with the privacy policy of BlueHabits GmbH at
www.bluehabits.app/datenschutz.

  1. Online Dispute Resolution and Consumer Arbitration

(1) The EU Commission provides a platform for online dispute resolution:

(2) BlueHabits GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).

  1. Amendments to the GTC

(1) BlueHabits reserves the right to amend these GTC, provided that this is reasonable for the user.

(2) The user will be informed in due time of any material changes.
If the user does not object within 30 days, the changes shall be deemed accepted.

  1. Final Provisions

(1) German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) Place of performance is Düsseldorf, to the extent permitted by law.

(3) Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.

(4) The contract language is German. An English translation is provided for convenience only.
